Terms & Conditions of Sales

In the interest of mutual respect and for the smooth operation of our services and your stays, we ask you to please read these terms and conditions carefully and accept them.

The person who accepts these conditions acknowledges being of legal age and having full legal capacity.

These terms and conditions apply to all bookings of DUNES Villas made on our Website or any other sales platform. Booking a villa implies acceptance of these terms and conditions of sale, which supersede all prior terms and conditions or any general terms and conditions of purchase.

Article 1 – General Terms and Conditions of Use of the Site

The User of this Site is responsible for damages of any kind, tangible or intangible, direct or indirect, caused to any third party and/or to Villas DUNES, as a result of the unlawful use and/or operation of the Villas DUNES site itself and/or any of its elements, regardless of the cause and location of such damages, and guarantees Villas DUNES against the consequences of any claims or actions which it may be subject to as a result.

The user of the Villas DUNES website waives all rights to take legal action against Villas DUNES in the event of legal proceedings brought against them by a third party due to the unlawful use and/or exploitation of the Villas DUNES website.

Article 2 – General booking conditions

By making a reservation, you agree to receive:

1/A confirmation email summarizing the terms of the booking contract, the services booked, the prices and conditions relating to the selected rate.

2/An email will be sent to you before your arrival so that we can best organize your arrival and arrange a meeting on site for the tour of the accommodation and the handing over of the keys.

3/ Arrival and departure: Arrival (time from which the villa is available): from 4 p.m. to 8 p.m.

It is best to give us your arrival time as soon as possible for better organization.

Departure (latest time by which the client must leave the villa): 10 a.m.

No late departures will be accepted.

We may ask you for a copy of your national identity card and/or passport, particularly for the purpose of securing payment (for example, in the absence of application of the 3D secure or SCA, Strong Customer Authentication, enhanced customer authentication system).


4/ Your email address must be complete and valid as we send your booking confirmation to this email.

5/ Your mobile phone number must be complete and real and the one you will use upon arrival.

6/ The tourist tax is regulated by the municipality of Bias/Mimizan. Since January 2024, it has been set at €1.58 per person per night. The tourist tax is added to the total amount of your reservation. Only adults are affected.

7/ Any behavior by the Client and/or his guests which is contrary to the principles of safety and/or hygiene, the rules of tranquility, good morals and/or public order may lead Les Villas DUNES to ask the Client to leave the reserved villa, without refund.

Article 3 – Payment Terms

Your bank card details are required by Les Villas DUNES on the Website to guarantee your reservation and payment. No banking information is stored on our Website but on a specialized and secure platform: ATOS (trusted third-party payment processing provider).

To protect and encrypt your bank card details as they pass through our Site, we use the standard SSL (Secure Socket Layer) security technology when providing our services. Bank transactions are processed via the ATOS platform.

Payment for your stay is made at the time of booking.

30% upon booking. The balance is due no later than 30 days before arrival.

Regarding cancellation conditions: See article 12

Article 4 – Security Deposit

A deposit will be required upon arrival, in the form of a bank check or bank guarantee.

The villa cannot be rented without this deposit. The deposit is set at 400 EUR per villa.

The deposit will be returned upon the client's departure after inspection and inventory of the premises.

If any damage or deterioration occurs during your stay, we reserve the right to present you with the invoices for the repairs responsible for your damages.

We can either take the bank deposit or cash the security deposit check and return the remaining balance to you. If the damage is too extensive, the entire deposit may be cashed and retained.

Article 5 – Animals

Animals considered dangerous (particularly category 1 and 2 dogs) and/or not considered pets are not allowed. Only one pet per villa is permitted, with a supplement of €35 per week.


Failure to comply with these regulations will result in an additional cleaning fee of one hundred euros (€100). Please contact us in advance for further information.

Article 6 – No smoking

The DUNES villas are strictly non-smoking. Failure to comply with this rule will result in a visit from a specialized cleaning and disinfection company. The cost of this service will be directly billed to the Client at a rate of one hundred euros (€100), corresponding to the price of the smoke removal cleaning.

Article 7 – Prohibition of domicile

The Resident is prohibited from using and disseminating as a primary residence or business address, the address of his suite and/or the address of the DUNES Villas.

By accepting these general terms and conditions of sale, the Resident acknowledges that he/she is not acting for commercial purposes in any way.

Article 8 – Insurance and personal belongings

Villas Dunes is not responsible for the safekeeping of any personal items left by the Resident in the Villa, whether he or she is present or not.

Your personal belongings and valuables are not covered by our insurance. We strongly recommend that you and anyone traveling with you insure all luggage, belongings, and valuables against loss or theft. Liability insurance is also advised for everyone.

During your stay, make sure to close the front door securely to avoid any problems.

Article 9 – Tranquility

The Resident will ensure that the peace and quiet is not disturbed at any time by his behavior and that of his guests. The use of sound devices (music, television, DVD) is permitted as long as the resulting noise does not disturb the neighbors and the laws and regulations (in particular Article R. 623-2 of the Penal Code) are observed.

The DUNES Villas are part of a residential complex. We ask all our residents to respect the peace and quiet and to abide by the village's internal regulations.

It is forbidden to organize any kind of party in the villa, or in the outdoor area such as the gardens, outside of the designated hours.

If this is the case, we expressly reserve the right to terminate your stay through the intervention of the Security team (between 350 and 650 euros depending on the time of intervention; this amount will be specified to you during the intervention).




Article 10 – Site Visit

Employees of the DUNES villas can access the rented space to check the proper functioning of the facilities, carry out repairs, refurbishments or transformations, at any time.

Article 11 – Compliance with laws and regulations

Each resident is responsible for any disturbances and violations of applicable laws and regulations, as well as the village's internal rules. The resident's internet use is subject to current French legislation (Books I and II of the Intellectual Property Code), and the resident remains responsible for any breach of this legislation. The DUNES villas are equipped with secure Wi-Fi with traceability. Access to certain websites is controlled.

Article 12 – Guarantee & Cancellation of Reservation

In case of damage and/or theft, Les Villas DUNES reserves the right to charge the amount of these to your bank card, or to cash the security deposit check and refund the difference to you.

The Villas les DUNES can accommodate a maximum of 6-8 people. We will not accept any more guests.

If it appears that the number of people occupying the villa exceeds that planned during the booking, a penalty of 50 euros including tax per additional person to the number indicated in the booking/ and per night may be requested.

Cancellation conditions:

For bookings made between September 1st and November 11th, and between February 1st and June 30th (arrival date):

Cancellation is free up to 14 days before the arrival date.

After this period, the cancellation fee amounts to the entire cost of the stay.

For bookings made between July 1st and August 31st (arrival date):

Cancellation is free up to 30 days before the arrival date.

After this period, cancellation fees amount to the full cost of the stay.

In accordance with the provisions of Article L.Article 221-2 of the Consumer Code and given the nature of the services provided, it is expressly stated that the Customer does not have the right of withdrawal.

The rental agreement is therefore definitively concluded upon placement of the order by the Client in accordance with the terms specified in these general terms and conditions of sale.

Article 13 – Shortened Stay

For any interruption of stay before the scheduled departure date, the entire originally planned stay will be charged as compensation.

The invoice that we issue at the end of your stay can be used, if necessary, to claim compensation (bank card insurance or other in case of illness or other serious incident covered by your insurance).

Price and location of the stay

Prices are shown in euros and include all taxes.

The villas are fully furnished and equipped, "ready to live in".

The beds are not made.

Prices do not include the provision of household linen and/or towels.

Accommodation is available from 4 pm on the day of your arrival. On the day of your departure, the premises must be vacated by 10 am at the latest.

Article 14 – Responsibilities

Villas DUNES declines all responsibility for death or personal injury or property damage to any person renting or using a villa DUNES unless it is due to proven negligence on the part of our staff or ourselves. Villas DUNES declines all responsibility for loss, damage, or delay due to any cause

Villas DUNES declines all responsibility for any loss, damage, or delay due to any cause beyond its control, including but not limited to force majeure, explosions, floods, storms, fire, accidents, acts of war or civil or terrorist threats, restrictive measures imposed by any official authority, strikes, demonstrations, etc. In such cases, the rental agreement may be terminated automatically without any compensation being due to the Resident. Villas DUNES cannot be held responsible for any failure of public utility services such as water, electricity, internet, or television.


Villas DUNES declines all responsibility for noise and nuisances of any kind which are beyond its control or which do not occur in the rented villa.


The Resident agrees not to use the villa for pedophilic, pornographic, terrorist or any other illegal purpose.

Villas DUNES cannot be held responsible if the villas are used for these purposes.

After departure:

Any item belonging to Villas DUNES that is not returned damaged or broken will be subject to an immediate charge for the replacement cost of the item, the amount of which may be deducted from the bank guarantee.

Article 15 – Unforeseen Circumstances

These general terms and conditions of sale expressly exclude the legal doctrine of unforeseen circumstances provided for in Article 1195 of the French Civil Code for all Services provided by Les Villas DUNES to the Client. The Client therefore waives the right to invoke the provisions of Article 1195 of the French Civil Code and the doctrine of unforeseen circumstances contained therein, undertaking to fulfill their obligations even if the contractual balance is disrupted by circumstances that were unforeseeable at the time of booking and the conclusion of the rental agreement, even if their performance becomes excessively onerous, and to bear all the resulting economic and financial consequences.

Article 16 — Services

Extra bed:

No extra beds can be added to the villas.

The existing sleeping arrangements cannot be changed.

Children :

A children's kit is available as an option: cot, high chair, bath…

On request = €20 each

Household :

A fee of EUR 100 per stay is due when purchasing a stay.

This price cannot vary.

Linen:

Bed linen and towels for indoor bathrooms are not provided.

Price: €16 per bed & €11 per towel kit

Parking: Depending on the villa, one or two standard-sized cars are permitted. (No additional vehicles will be allowed.)
